FLORIDA FAMILY COURTS VIOLATE FIRST AMENDMENT Dr. Mario Jimenez“I have filed a federal lawsuit on behalf of my children and all Americans of faith regardless of their religion,” said Mario Jimenez, who has a medical practice in Miami-Dade County. “I need their help to send a strong message to family courts that unconstitutional violations will no longer be tolerated by the American people.”

Jimenez said he lost equal shared custody of his two older children with only one accusation leveled at him by his mentally unstable and vindictive ex-wife. “She said I was scaring my children when I would pray with them the Armor of God Ephesians 6.” The sham “emergency” telephonic hearing lacked proper notice, was without ability to present a defense or evidence to rebut.  Even though Florida 3rd District Court reversed a previous case with identical modus operandi,  Florida Family court turned a blind eye and ear to Dr. Jimenez due process and parental rights without a shred of due process .

When Jimenez presented evidence to the trial court to show that the accusation was false, he said the court ignored him and his family has suffered tremendously. “Three years after the forced separation of my children, my son went from being one of the best students in class to one of the worst.” The children’s behavior continues to deteriorate, he said.

“The psychologist used to perpetuate this crime against me had been involved just a few months prior to my case with the death of Nubia Barahona, and the torture of her three siblings,” he said. “Instead of being reprimanded for this, she was promoted to evaluate cases such as mine.”

The First Amendment guarantees the free exercise of religion, yet a Family Court judge was permitted to take that away from him, said Jimenez. “Freedom of religion is being able to practice, foster, and share one’s faith with your loved ones unencumbered from government interference.”
